Our Pool and Spa are currently under re-surface construction. The project is behind the original projected schedule (completed by end of April). The delays were caused by late phase payment, scheduling of the city inspector, and post inspection remedy.
The estimated pool open date is around end of May/early June.

The Pool Spa project has been going on for almost 4 months. The HOA have just posted approx 60 words of explanation after 3 months of closure.
They blame the delay on the city inspector.
The truth is they closed the pool before they even started thinking what needed to be done, when how much it would cost. All basic responsibilities of any HOA. The project has not been project managed. The contractors are allowed to do what they want (including illegal flushing contaminated water into the public drains) when they want and probably for costs they decide. Off course the city inspector was not scheduled because no one thought to have a plan.
Today, 4 months after closure there is still no firm date of opening. Costs, who knows?
The HOA simply demonstrate they can not plan nor execute in a professional manner.
I do not believe any other condo has had these problems with their pool. No other homeowners are kept in the dark by there HOA and then fed excuses blaming others for their failures.
Thanks for your questions. The board was notified around the first of the year that a new law had passed that required new drain arrangements in public pools, like ours. The letter below was generated to explain the board decision that was discussed at the January Board meeting on January 15. Basically the liability to our HOA was extreme due to this new law and the board closed the pool to remove this liability.
Five vendors bid the pool renovation and three were down selected to make presentations to the board. We included our long time pool maintenance company in these discussions because they see lots of pool renovations. After these discussions and some leg-work by a sub-committee a recommendation to select Pool1 was passed by the board. All costs were strictly detailed in the contract with the exception of two items (coping tiles and improper fence gap) that were encountered during the renovation.
Yes the city inspection caused some delays. First, when the permit was first pulled there was a three day lead time for inspections, a couple of weeks later when Pool1 called for the inspection the lead time was two weeks. Second, the improper gap between our fence and the ground caused us to fail inspection. This was not the fault of our vendor Pool1 and in fact all of their work passed inspection. Pool fences are required to have less than a 2 inch gap over dirt or less than a 4 inch gap over concrete. These gaps are designed so that unsupervised crawling infants cannot access the pool.
Today after the fence installation was overcome we passed inspection. Tomorrow the pool should be plastered and immediately after the process of filling the pool with water will began. As with many renovation projects obstacles must be overcome along the way. Soon our patience will be rewarded by a newly renovated and I expect beautiful pool.

Re: POOL AND SPA CLOSURE - Virginia Graham Baker Pool and Spa Safety Act
Dear Villas Mallorca Homeowner:
We regret to inform you that we expect the Villas Mallorca community pool and spa to be closed up to three months because the drains are no longer in compliance with Federal Law. A new law that went into effect at the end of the year (December 2008) has increased pool and spa drainage safety standards. This new law helps protect swimmers from underwater entrapments. Many pools were able to reach a simple compliance with this law by switching drainage covers. However, the Villas Mallorca Pool and Spa are both of an age that more complicated drain re-plumbing is required for compliance with the new law. We will fully consider all options to regain federal compliance in the most efficient and effective manner.
Additionally, the life expectancy of the pool plaster has expired. Since we have to patch the new drain plumbing area and the pool will be empty, it makes sense to also re-plaster our pool and spa. Other deck and tile maintenance issues will also be addressed in this project. Our reserve fund has the money to pay for this work.
The good news is that we expect the pool to look great once we complete the renovation. The bad news is, because of current non-compliance with new federal law, we must close the pool immediately. Our association cannot risk the liability of keeping the pool open while it is out of compliance. Please understand we will be making these repairs in the most expedient manner. However, this is a large undertaking and the board must evaluate multiple solutions and proposals to ensure that this project is completed correctly.

It might be worth while to replacing the pool and spa lights with energy saving LEDs since the water is drained.
